Il centralismo governativo su cui si basa la riforma della logistica italiana incontra il primo ostacolo costituzionale, quello del conflitto Stato-Regioni. Proprio il ricorso di una Regione, la Campania, è stato accolto dalla Corte costituzionale che, con una sentenza depositata l’11 dicembre (sentenza 262/2015) , ha dichiarato illegittimo l’articolo 29 dello “Sblocca Italia”, approvato nel settembre dello scorso anno. È l’articolo del piano nazionale della logistica, quello che ha portato in poco meno di un anno a un “censimento” del parco infrastrutturale dei porti, delle strade, delle ferrovie e degli aeroporti italiani, permettendo di disegnare la riforma dei porti delle Autorità di sistema.
Per la Corte costituzionale ad essere illegittimo è il fatto che l’articolo 29 (misure urgenti per l’apertura dei cantieri, la realizzazione delle opere pubbliche, la digitalizzazione del Paese, la semplificazione burocratica, l’emergenza del dissesto idrogeologico e per la ripresa delle attività produttive) «non prevede che il piano strategico nazionale della portualità e della logistica sia adottato in sede di Conferenza Stato-Regioni». È illegittimo insomma non coinvolgere le Regioni nella pianificazione di opere strategiche quali strade, porti, ferrovie e aeroporti. È una vittoria per tutti quegli enti che si sentono estromessi dalla nuova portualità che dovrebbe arrivare con la riforma. Si prevede, infatti, per le regioni un ruolo consultivo e non più vincolante nella nomina del presidente dell’Authority, lasciando al ministero dei Trasporti la scelta.
